Josh Weinberg’s practice is at the forefront of representing insurers in mass tort bankruptcy cases, ranging from asbestos, talc and product liability cases to sexual abuse cases. Josh has served as lead bankruptcy counsel for insurers in high-profile bankruptcy cases, including In re USA Gymnastics (Bankr. S.D. Ind.).

In addition to “traditional” bankruptcy proceedings, Josh has extensive experience in state court “analogs” to bankruptcy. Josh has represented insurers in hearings and at trial in state court receivership proceedings, including dissolution and contribution bar (injunction) proceedings, and consults with insurers on state insurance insolvency, rehabilitation, and liquidation proceedings.

Josh also has extensive experience in representing debtors and creditors in all phases of complex chapter 7 and chapter 11 bankruptcy proceedings, including: 

  • Contested claim allowance and estimation hearings 

  • Lift stay motions and litigation regarding alleged stay violations

  • DIP financing and cash collateral motion practice

  • Disputes concerning availability of estate property

  • Rule 2004 discovery

  • Chapter 11 Plan drafting and negotiations

  • Contested disclosure statement hearings and confirmation battles

  • Section 363(f) “free and clear” sales of property

  • Challenges to appointments of experts and other professionals

  • Prosecution and defense of avoidance actions

Josh maintains an active insurance and commercial litigation practice. Josh represents insurers in complex and high-stakes insurance coverage disputes in state and federal courts across the country. The broad range of cases where Josh has had significant success includes both defending insurers against claims for coverage as well as the active pursuit of claims for contribution and subrogation.

Prior to founding Ruggeri Parks Weinberg LLP in 2022, Josh worked at Wilmer, Cutler & Pickering LLP and was a partner at Hogan & Hartson LLP and a New England law firm. Immediately following law school, Josh served as law clerk to the Honorable Edward E. Carnes of the U.S. Court of Appeals for the Eleventh Circuit in Montgomery, Alabama.
